AnimalHypnoshift Terms and Conditions

These terms are between you and Victoria Sambleson, operating as AnimalHypnoShift, 3 Templeton Cres, Barrie, Ontario L4N 6G1, Canada ("I", "me", "my"). "You" means the person purchasing.

By registering for a workshop, purchasing any product or recording, booking a session, joining a program or membership, or accessing any material I supply, you agree to these terms. If you do not agree, do not purchase

Products covered by these terms

Workshops: Know in 90 Pet Breakthrough Workshop, The Empath Workshop, The Heart Connection Workshop, and any other live or recorded workshop.

Audio programs and digital downloads: The Reactive Dog Reset, The Sensitive Cat Reset, Things That Go Boom, Oh No Not The Vet, The 5 Minute Nervous System Reset, The Empath's Emotional First Aid Kit, The Empath's Journey, And Off We Went, and any other recording, guided hypnosis track, audio session, guide or downloadable material.

1:1 services: private energy sessions, energy readings at all price tiers, Dial It In, the Pet Breakthrough Accelerator call, and the Quick Wins sessions (the Monkey Mind Reset, the Double Cortisol Reset, the Animal Communication Intensive, the Empath Survival Kit, the Rainbow Bridge Connection, the Energy Healer Rescue, and any other Quick Wins session offered from time to time).

Programs: the Pet Relationship Rescue Bootcamp, The Reentry Program, and any other group program, bootcamp or course.

Membership and training: The Sofa, and the Animal Turnaround Method.

Also covered: order bumps, one-time offers, upsells, bonuses, free resources, quizzes, lead magnets and community access.

1. SCOPE OF SERVICES AND RESULTS

My methods are not veterinary care, medical care, psychological treatment or professional animal training. I work with energy, emotion, subconscious patterns and hypnosis.

I am not a veterinarian, and I do not diagnose, treat or prescribe for any animal.

I am not a physician, psychologist, psychiatrist, therapist or counsellor.

I am not a certified animal trainer or behaviourist.

I am not a crisis or emergency service. In an emergency involving a person, contact your local emergency number. In an emergency involving an animal, contact your veterinarian or an emergency veterinary clinic.

Your animal should be assessed by a licensed veterinarian before you begin work with me on any health issue.

You must not stop, delay, reduce or alter any veterinary treatment, medication, prescribed care or training program as a result of this work. Any such change is a decision for the professional who prescribed it.

Results vary. Every animal and every person responds differently, and factors outside the work may influence any outcome. I make no representation, warranty or guarantee as to any particular result. Testimonials describe individual experiences and are not a prediction of your outcome.

2. YOUR COMMITMENT

Participate fully in sessions.

Complete any recommended exercises between sessions.

Disclose your animal's history, health and medications accurately, and your own where relevant.

Keep scheduled appointments or provide 24 hours' notice of cancellation.

Notify me promptly of any change to the information you have given me.

3. MY COMMITMENT FOR 1:1 SESSIONS

Professional care for you and your animal.

Confidentiality, subject to section 13.

Email support between sessions during the period you have paid for. I aim to respond within one business day.

4. YOUR ANIMAL

You confirm that you are the legal guardian of any animal involved in the work, or that you have the guardian's authority to involve that animal.

You remain solely responsible for your animal at all times, before, during and after any session or program. This includes their care, supervision, handling, containment, veterinary treatment, and the safety of all persons and animals around them. Nothing in this work transfers, shares or suspends that responsibility.

You must not relax any management, containment, restraint or safety measure as a result of this work. Behaviour may change gradually, unevenly, or not at all, and may temporarily intensify

You are responsible for any injury, loss or damage caused by your animal, whether or not it occurs during or following work with me.

I do not handle animals physically. The work is energetic and is conducted through you. Your animal need not be present.

5. GUARANTEES AND REFUNDS

5.1 Digital products and workshops: 30 day money-back guarantee

A 30 day money-back guarantee applies to every workshop, audio program, recording, guided hypnosis track, download, guide and group program, including the Know in 90 Pet Breakthrough Workshop, The Empath Workshop, The Heart Connection Workshop, The Reactive Dog Reset, The Sensitive Cat Reset, Things That Go Boom, Oh No Not The Vet, The 5 Minute Nervous System Reset, The Empath's Emotional First Aid Kit, The Empath's Journey, and the Pet Relationship Rescue Bootcamp.

To request a refund, email [email protected] within 30 days of purchase. No reason is required.

Refunds requested within 30 days are issued to the original payment method. Where that is not possible, another method will be arranged, usually PayPal transfer.

On refund, your access ends, your licence to use the material ends, and you must delete any downloaded copies.

An order bump, one-time offer or upsell that is itself a digital product or workshop carries the same 30 day guarantee

5.2 Live 1:1 services: no refund once delivered

No refund is available for private energy sessions, energy readings at any tier, Quick Wins sessions, Dial It In, or the Pet Breakthrough Accelerator call once the session has been delivered. Outcomes depend on your consistency, your own energetic and emotional patterns, and your animal's individual response, none of which can be guaranteed.

An order bump, one-time offer or upsell that is a live 1:1 service is not refundable once delivered.

Unused sessions in a package may be discussed with me. Any adjustment is at my discretion.

5.3 Excluded

The Sofa and the Animal Turnaround Method are not covered by any money-back guarantee. Refunds for those products are governed by their own terms.

5.4 Limits

One guarantee applies per person, per product. Repurchasing a refunded product does not restart the guarantee period. I may decline to sell to any person who has repeatedly requested refunds.

5.5 United Kingdom and European Union purchasers

You have a statutory right to cancel a digital purchase within 14 days. The 30 day guarantee in section 5.1 exceeds that right. For live 1:1 services, by booking a session within the 14 day period you request that performance begin immediately and accept that the right to cancel is lost once the session has been delivered.

6. BOUNDARIES AND LIMITS

I work with animal behaviour and health concerns only. I do not provide medical or veterinary diagnosis.

I may decline or discontinue service where guidance is not followed, where continuing would be unsafe or unsuitable, or where conduct toward me or toward others is abusive.

You may not record any session, call or group meeting without my prior written permission.

Recordings I supply are licensed for your personal use only.

7. CONTRAINDICATIONS AND PARTICIPANT SUITABILITY

Subconscious work, Hypnosis, deep relaxation and energy work are not suitable for everyone.

You must consult your healthcare provider before participating, and must inform me, if any of the following apply to you:

Psychosis, schizophrenia, delusions or hallucinations

Severe depression, or depression requiring medical intervention

Suicidal ideation or thoughts of self-harm

Epilepsy or any seizure disorder

Severe cognitive impairment or traumatic brain injury

Active drug or alcohol dependency

Chronic pain that has not been medically investigated

Inability to concentrate or maintain focus for extended periods

Any advice from a healthcare provider to avoid hypnosis, meditation or deep relaxation

This list applies to all products, including workshops, recordings, 1:1 sessions, group programs and membership activities.

You confirm that you are 18 years of age or older, that you are participating with full capacity and of your own volition, that you are able to give informed consent, and that you are not under the influence of alcohol or recreational drugs when participating

If your circumstances change during our work together, you must inform me immediately. I may pause, decline or discontinue sessions on safety grounds. Where I do so, no refund is due for services already delivered.

Subconscious work may produce an emotional response during or after a session or recording. Responsibility for your own wellbeing remains with you. If a response persists or exceeds what you expected, consult a qualified healthcare provider.

8. PAYMENT TERMS

Currency. All prices are in United States dollars and all checkouts charge in United States dollars. Exchange rates and any foreign transaction fees are set by your bank or card issuer.

Taxes. Prices exclude any applicable sales tax, GST, HST or VAT unless stated at checkout. Where I am required to collect tax, it is added at checkout.

Payment. Full payment is due before delivery of the first session, module or download.

Payment plans. Where a payment plan is offered, you are committing to the full purchase price, not to the first instalment. Instalments are charged automatically on schedule. If a payment fails, I may retry it and will notify you. Access may be suspended until the balance is cleared. The balance remains payable.

Pricing. I may adjust pricing at any time. Changes do not apply retroactively to purchases already made.

Coupons and promotional codes. Discounts apply as stated at the time of purchase, cannot be applied retroactively, and cannot be combined unless expressly stated. Codes are non-transferable and may be withdrawn or amended at any time. Where a discount applies to a first payment only, this is stated at checkout and any renewal is charged at the standard rate.

Order bumps, one-time offers and upsells. These are separate purchases governed by the terms displayed at the point of purchase. Some are time-limited and the stated window is enforced. Refund treatment is set out in section 5.

Chargebacks. You must contact me at [email protected] before initiating a chargeback or payment dispute. Initiating a dispute without doing so is a breach of these terms. Where a dispute is raised, I may immediately terminate your access to any product, recording, community or program, and may recover the disputed amount together with any fees charged to me as a debt. A chargeback raised in addition to a refund already issued will be treated as a duplicate claim.

9. SCHEDULING AND CANCELLATION

Sessions and readings are booked through my calendar link.

Cancellation or rescheduling requires at least 24 hours' notice. A no-show, or cancellation on less than 24 hours' notice, forfeits that session.

Where I cancel a session, it will be rescheduled at no cost to you.

Sessions purchased in a package do not expire and remain available until used. Packages are non-transferable and are scheduled subject to my availability.

Energy readings are delivered live by Zoom and are not recorded unless agreed in advance by both parties. Readings are capped at 30 per month and are subject to availability.

Live workshops run on the dates advertised. Where a date is changed, notice will be given and you will receive access to the recording or a place on an alternative run.

Where a product states lifetime access, this means for as long as the product is offered. If a product is withdrawn, at least 30 days' notice will be given so that you may download your copy. You are responsible for retaining your own copies.

10. THE SOFA MEMBERSHIP

The Sofa is governed by The Sofa Membership Terms, which apply in addition to these terms. The following provisions apply in all cases.

Automatic renewal. All Sofa subscriptions and passes renew automatically at the standard rate for the term selected until cancelled. Cancellation must be completed before the renewal date. Renewal notices are issued monthly in advance of charges

Promotional pricing. Promotional discounts and special offers apply to the first payment only. On renewal you will be charged the standard rate for your subscription or pass term. Promotional pricing is stated at the time of purchase and it is your responsibility to understand the renewal price before purchasing.

Cancellation. You may cancel at any time inside the membership portal. You retain access until the end of your current billing cycle, whether weekly, monthly, annual, or on a 1, 3, 6 or 12 month pass. Cancellation stops future billing only. No refund is issued for the unused portion of a current billing cycle. If you rejoin after cancelling, you will do so at the rate then current.

External payment providers. If you pay through an external payment provider such as PayPal, cancelling inside the membership portal alone may not stop future billing. You must also cancel the recurring subscription directly with that provider, and confirm cancellation in both places. I am not responsible for continued billing where cancellation has been completed in only one location.

Individual accounts. Each membership is for one individual. Memberships may not be shared between household members, family members or friends. Each participant requires a separate membership and payment.

Group sessions. Live sessions run weekly and are scheduled at my discretion. I may change meeting times and dates, with a minimum of 48 hours' notice where practicable. Sessions may be rescheduled due to technical issues, illness or unforeseen circumstances. Make-up sessions are provided where technically feasible. Session recordings may be made available but are not guaranteed.

Conduct and removal. Members are expected to participate respectfully. I may remove any member who disrupts sessions or breaches community guidelines. Removed members forfeit remaining access without refund

Contraindications. Section 7 applies to all membership activities, including group sessions

Programme discontinuation. I may discontinue The Sofa at any time, with 30 days' notice where practicable. Where I discontinue the membership, members receive a pro-rated refund for the unused portion of their current billing cycle or pass term.

11. THE ANIMAL TURNAROUND METHOD

The Animal Turnaround Method is practitioner training and is governed by the Animal Turnaround Method Agreement signed at enrolment. The following provisions apply in all cases.

The training is not a certification, licence or accreditation, and is not accredited by any governing or regulatory body.

Completion does not qualify you to practise in any jurisdiction. You are solely responsible for determining whether you may lawfully offer this work where you live, for obtaining any required registration, and for maintaining your own professional insurance.

No income, client volume or business outcome is guaranteed or implied.

Participation creates no employment, agency, partnership or joint venture relationship between us.

You may not teach, train, licence, resell, repackage or otherwise distribute the Animal Turnaround Method or any of my materials to any third party.

Any licence to use my scripts, recordings or frameworks in your own practice is granted only in the Animal Turnaround Method Agreement, on the terms stated there, and may be revoked.

Use of the AnimalHypnoShift name, or any representation of affiliation with me, is permitted only as expressly set out in that agreement.

12. DIGITAL DOWNLOADS AND RECORDINGS

Refunds. Digital downloads are covered by the 30 day money-back guarantee in section 5.1

Conditions of use. Use recordings in a quiet, comfortable environment free from interruption. Use a seated position rather than lying down. Headphones are recommended. Allow uninterrupted time to complete the full session

Safety. Do not use any recording while driving, operating machinery, supervising a child or animal, or engaged in any activity requiring attention or alertness, or in any situation where loss of focus could result in harm.

Professional care. Recordings are not a substitute for medical treatment, psychological or psychiatric care, veterinary treatment, or professional animal training or behaviourist services. Consult a qualified healthcare provider for personal health concerns, a licensed veterinarian for animal health concerns, and a qualified behaviourist or certified trainer for behaviour concerns. Recordings are complementary to professional care, not a replacement for it.

Results. Individual results vary and no specific outcome is guaranteed. You use this content at your own risk.

Contraindications. Section 7 applies to all recordings.

13. RECORDINGS, CONFIDENTIALITY AND PERSONAL INFORMATION

Confidentiality. The content of 1:1 sessions, and information you provide about yourself, your animal and your household, is kept confidential.

Exceptions. Information may be disclosed where required by law, where there is a serious risk of harm to any person or animal, and to service providers who operate my business systems and who are bound to confidentiality. In group settings I cannot control disclosure by other participants.

Recording. Group calls and some 1:1 sessions are recorded so that replays can be provided. By participating you consent to being recorded. If you do not wish to be recorded, notify me before the session begins. Energy readings are not recorded unless agreed in advance.

Testimonials and case material. Anonymised and non-identifying descriptions of client work may be used freely. Your name, your animal's name, or any identifying detail will not be used without your prior consent. Consent may be withdrawn by email, and the material will be removed from anything within my control.

Personal information. Collection, use and storage of your information is governed by my Privacy Policy, which forms part of these terms. Health information you provide about yourself or your animal is used solely to deliver the services.

Marketing communications. On purchase or opt-in you will receive email communications. Every marketing email contains an unsubscribe link. Unsubscribing from marketing does not stop transactional emails required to deliver a product you have purchased.

14. INTELLECTUAL PROPERTY

All recordings, scripts, hypnosis sessions, workshop content, frameworks, exercises, workbooks, written material, graphics, the AnimalHypnoShift name, and all product names listed in these terms are my property and are protected by copyright.

You are granted a personal, non-exclusive, non-transferable licence to use purchased material for yourself and your own animals, for the duration of your access.

You may not:

Share, sell, lend, gift, upload or distribute any material

Share login credentials or permit any other person to use your access

Record, screenshot, transcribe or reproduce sessions, calls or content

Use any material in a commercial setting, with clients, or in any practice of your own

Teach, reproduce, adapt or train any other person in my methods or materials

Submit any material to an artificial intelligence system for training, fine-tuning or generation

Remove or alter any attribution or identifying mark

Training in the method is available only through the Animal Turnaround Method. No other purchase confers any right to practise, teach or offer this work to third parties.

Breach of this section terminates your licence and your access immediately, with no refund. I reserve the right to seek injunctive relief in addition to damages.

Your own experience, insights and observations remain yours.

15. COMMUNITY SPACES

Certain products include access to a private Facebook group or other community space.

Members must conduct themselves respectfully. Members must not provide veterinary, medical or legal advice to other members, must not solicit or promote, must not share the content of other members' posts outside the group, and must not record or screenshot other participants.

I may remove any member whose conduct is disruptive or harmful to others.

Community spaces operate on third-party platforms outside my control. I am not responsible for the availability of those platforms or for any action they take in respect of your account.

16. THIRD-PARTY PLATFORMS

Checkout, scheduling, email, video delivery, community and course hosting are operated through third-party services including GoHighLevel, Zoom, PayPal, Stripe and Facebook. I am not responsible for their outages, failures or changes, and will make reasonable efforts to deliver purchased services by alternative means where such an event occurs.

17. LIABILITY

Services provided as is. To the fullest extent permitted by law, I exclude all warranties, conditions and representations not expressly set out in these terms, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or achievement of any result.

Assumption of risk. You participate at your own risk and are responsible for how you apply what you learn and for all decisions concerning your animal, your health and your household.

Exclusions. To the fullest extent permitted by law, I am not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, income or opportunity, veterinary costs, property damage or emotional distress, arising from the services, the materials, these terms, or any action taken as a result of them.

Cap on liability. My total aggregate liability to you for all claims, however arising, will not exceed the total amount you paid me in the twelve months preceding the event giving rise to the claim.

Non-excludable liability. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited. Where you hold rights under consumer protection legislation that cannot be excluded, those rights are unaffected and this section is read down accordingly.

Indemnity. You agree to indemnify me against any claim, loss, cost or expense, including reasonable legal fees, brought by a third party and arising from your animal, your use of my materials, your breach of these terms, or any service you offer to another person on the basis of this work.

1:1 waiver. 1:1 clients sign a separate liability waiver. That waiver covers the number of sessions paid for in advance. Additional sessions require a further waiver.

18. TERMINATION

You may discontinue at any time. Refunds are governed by section 5.

I may terminate your access where you breach these terms, where your conduct toward me or others is abusive, where guidance is not followed to an extent that makes the work unsafe or ineffective, or where your circumstances make continuation inappropriate. Where termination results from your conduct or breach, no refund is due. Where I terminate for any other reason, the undelivered portion will be refunded.

19. GENERAL

Amendments. I may update these terms. The version published at the time of your purchase governs that purchase. For subscriptions and ongoing programs, reasonable notice of any material change will be given by email, and continued participation after the stated date constitutes acceptance.

Force majeure. I am not in breach of these terms where performance is prevented or delayed by circumstances beyond my reasonable control, including illness, bereavement, platform or utility failure, or natural disaster. In such circumstances services will be rescheduled, delivered by alternative means, or refunded in respect of the undelivered portion.

Dispute resolution. Before commencing any formal proceedings, you must notify me in writing at [email protected] and allow 30 days for resolution.

Governing law and jurisdiction. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have jurisdiction, without prejudice to any right you may have to bring proceedings in your place of residence under applicable consumer law.

Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed. The remaining provisions continue in force.

Entire agreement. These terms, together with the 1:1 liability waiver, The Sofa Membership Terms, the Animal Turnaround Method Agreement and the Privacy Policy where applicable, constitute the entire agreement between us and supersede any prior representation made by email, on a call, in a message or on a sales page.

Waiver. Failure to enforce any provision does not waive the right to enforce it subsequently.

Assignment. You may not assign your rights under these terms. I may assign mine in the event of sale, restructuring or transfer of the business, and your rights are unaffected.
