THE SOFA — MEMBERSHIP TERMS

These terms are between you and Victoria Sambleson, operating as AnimalHypnoShift, 3 Templeton Cres, Barrie, Ontario L4N 6G1, Canada ("I", "me", "my"). "You" and "member" mean the individual holding the membership.

These terms apply in addition to the AnimalHypnoShift Terms and Conditions. Where the two conflict on a matter concerning The Sofa, these terms govern.

By joining The Sofa, or by continuing your membership at any renewal, you agree to these terms.


1. CONFIDENTIALITY

This is the most important term in this document. Membership depends on it.

The Sofa is a group setting. Members disclose personal circumstances, private information about their households, their relationships, their health and their animals. Every member is entitled to expect that what they share stays within the group.

What is confidential. Everything said, shown, written or shared by any member, in any Sofa space. This includes live calls, group hypnosis sessions, the community group, chat, comments, direct messages arising from the membership, and any recording or replay.

Your obligations as a member:

You must not repeat, quote, paraphrase, summarise or describe anything another member has shared, to any person outside The Sofa. This includes your partner, your family, your friends, other practitioners, and any public or private forum, social media platform or group.

You must not identify any other member outside The Sofa, by name, by animal, by circumstance, or by any detail that could reasonably identify them.

You must not record, screenshot, photograph, screen-capture or transcribe any live call, group session, community post, comment or message.

You must not share, forward or distribute any recording, replay, material or screenshot supplied to you as a member.

You must not use anything shared by another member for your own commercial, professional, promotional or content purposes.

You must not contact another member outside The Sofa about something they shared inside it, unless they have invited you to.

Duration. These obligations apply from the moment you join, for as long as you are a member, and permanently after your membership ends. They are not released by cancellation, expiry or removal.

My obligations. I hold the same standard. I do not disclose what members share, except where required by law, where there is a serious risk of harm to any person or animal, to service providers who operate my business systems and who are bound to confidentiality, or as set out immediately below.

Success stories. I share success stories from this work. They appear in emails to my list, in my teaching, and in my marketing, content and materials, because they are how people come to understand what this work does.

Names are always removed. I will not use your name, your animal's name, your location, your photograph, your voice, or any other detail that could reasonably identify you, your household or your animal, without your prior written consent. What I share is the pattern and the shift, not the person.

Where you have given consent, you may withdraw it at any time by emailing me, and I will remove the material from anything within my control.

Limits I cannot control. I hold every member to this standard and enforce it. I cannot guarantee the conduct of another member. Use your own judgment about what you choose to share in a group setting.

Breach. A breach of this section is grounds for immediate removal from The Sofa without refund, and may give rise to a claim for damages. This is not a formality and it will be enforced.


2. MEMBER CONDUCT

The Sofa works because members feel safe in it. The following is expected of everyone, including me.

What is expected:

Treat every member with respect and courtesy, in live sessions, in writing, and in any Sofa space.

Let people finish. Share the airtime.

Accept that members are at different stages, hold different beliefs, and work with different animals and circumstances.

Keep contributions relevant to the session and to the work.

Respect the boundaries another member sets about what they are willing to discuss.

Arrive ready to participate, in an environment where you can focus.

What is not accepted:

Any breach of section 1.

Abuse, harassment, intimidation, threats, or targeting of any member or of me.

Discriminatory, demeaning or hateful remarks about any person or group.

Giving veterinary, medical, psychological or legal advice to another member.

Diagnosing another member's animal, or telling another member to change, stop or delay veterinary treatment, medication or training.

Selling, recruiting, promoting, or soliciting members for any business, offer, program, product or cause.

Repeatedly disrupting sessions, dominating discussion, or preventing others from participating.

Sharing another member's information, or using membership to gather information about others.

Sharing your login, or allowing any other person to access the membership through your account.

Recording, screenshotting or capturing any part of the membership.

I may remove or edit any content in a community space, and may suspend or remove any member, where conduct falls below this standard. Section 14 sets out how removal works.


3. RAISING A CONCERN

If a conflict or concern arises, email me directly and immediately at [email protected].

This applies to any conflict with another member, anything said or done in a session that troubled you, any conduct you believe breaches these terms, any concern about how the membership is run, and anything about your own participation you are uneasy with.

Bring it to me first, and bring it early. Do not raise it in the group, do not raise it with other members, and do not take it to a public forum or social media. A concern raised directly can usually be resolved. A concern raised anywhere else cannot, and may itself breach section 1.

I will respond, and I aim to do so within one business day.


4. MEMBERSHIP, BILLING AND AUTOMATIC RENEWAL

Read this section before you join.

Your membership renews automatically. At the end of each billing cycle, your membership renews for a further cycle of the same length and the renewal payment is charged automatically to the card or payment method you used to join. This continues until you cancel.

This applies to every membership type, including weekly, monthly and annual subscriptions, and the 1 Month, 3 Month, 6 Month and 12 Month Passes. A pass is not a one-time purchase. It renews at the end of its term unless you cancel.

You will be charged the standard rate. Renewal is charged at the standard rate for your membership type at the time of renewal, not at any promotional or introductory rate you may have paid to join. See section 6.

Changing your payment method. If you want a renewal charged to a different card, or want your payment method updated, you must tell me before the renewal date. Email [email protected]. Until you do, renewals are charged to the payment method on file.

Notice. Renewal notices are issued monthly in advance of upcoming charges as a courtesy. Non-receipt of a notice does not cancel a renewal, extend a billing cycle, or entitle you to a refund. Responsibility for knowing your renewal date rests with you, and your renewal date is visible in your profile inside the membership area.

Failed payments. If a renewal payment fails, I may retry it and will contact you. Access may be suspended until payment clears.

Pricing. Membership rates may change. Any change to the rate applying to your renewal will be notified by email in advance.

Currency. All prices are in United States dollars and all checkouts charge in United States dollars. Exchange rates and any foreign transaction fees are set by your bank or card issuer.


5. CANCELLATION

To stop payment, you must cancel before your next billing cycle begins.

How to cancel. Log in to the membership area, go to the profile section, and cancel your membership there. Cancellation takes effect from that point forward.

Timing. Cancellation must be completed before your next billing date. A cancellation submitted on or after the renewal date does not reverse that renewal charge and does not entitle you to a refund of it.

What cancellation does. Cancellation stops future billing only. It does not refund any payment already taken.

Access after cancelling. You keep access until the end of the billing cycle you have already paid for, whether that is a weekly, monthly or annual subscription, or a 1, 3, 6 or 12 Month Pass. Access ends at the end of that cycle.

No refund for the unused portion. No refund is issued for any unused part of a cycle you have paid for.

Rejoining. If you cancel and later rejoin, you do so at the rate current at that time. Previous or founding rates are not reinstated.


6. PROMOTIONAL PRICING

Promotional discounts, coupons, founding rates and special offers apply to the first payment only unless expressly stated otherwise in writing.

On renewal you will be charged the standard rate for your membership type.

For example, a 12 Month Pass purchased at a promotional rate is charged at that rate for the initial payment. At the end of the twelve months, the renewal is charged at the full standard 12 Month Pass rate.

All promotional pricing is stated at the time of purchase. Understanding the renewal price before you buy is your responsibility.


7. EXTERNAL PAYMENT PROVIDERS

If you pay through an external payment provider such as PayPal, cancelling inside the membership area alone may not stop future billing.

You must also cancel the recurring payment directly with that provider.

To cancel fully:

Cancel your membership in the profile section of the membership area.

Log in to your payment provider account and cancel the recurring payment or subscription there.

Confirm cancellation in both places.

I am not responsible for continued billing where cancellation has been completed in only one location. If you are unsure of your subscription status, contact your payment provider directly.


8. INDIVIDUAL MEMBERSHIP ACCOUNTS

Each membership is for one individual person.

Memberships may not be shared between household members, family members, friends or colleagues. Login credentials may not be shared. If more than one person in a household wishes to attend group sessions or access membership materials, each person requires a separate membership and payment.

Sharing access is a breach of these terms and of section 1, and is grounds for removal without refund.


9. LIVE SESSIONS AND SCHEDULING

Live group sessions run weekly and are scheduled at my discretion.

I may change meeting times and dates, and will give a minimum of 48 hours' notice where practicable.

Sessions may be rescheduled or cancelled due to technical issues, illness or unforeseen circumstances. Make-up sessions are provided where technically feasible.

Session recordings may be made available but are not guaranteed. Where a recording is not available, no refund or credit is due.

Attendance is not required, and no refund or credit is due for sessions you do not attend.


10. MEMBER BENEFITS

Membership benefits, which may include vault access, member access to selected products, and a member discount on 1:1 work, are available only while your membership is active and paid.

All benefits end when your membership ends. Vault content, recordings and member materials are accessed under licence for the duration of your membership. They are not yours to keep, download for retention, or use after your membership ends.

Benefits offered may change. Any material reduction will be notified in advance.


11. PARTICIPANT SUITABILITY

The contraindications and participant suitability provisions of the AnimalHypnoShift Terms and Conditions apply in full to all membership activities, including live sessions, group hypnosis sessions and recordings.

You must consult your healthcare provider before participating, and must inform me, if any of the listed conditions apply to you.

If your circumstances change during your membership, you must tell me immediately. I may pause or discontinue your participation on safety grounds, for your wellbeing and that of the group. Where I do so, no refund is due for the unused portion of your cycle.

The Sofa is not a crisis service, a therapy group, or a substitute for medical, psychological or veterinary care.


12. RECORDINGS AND MATERIALS

Live sessions are recorded so that replays can be provided to members. By attending a live session you consent to being recorded. If you do not wish to appear in a recording, notify me before the session begins and keep your camera and microphone off.

All recordings, replays, teaching materials, exercises, frameworks and written content supplied through The Sofa are my property and are protected by copyright.

You are granted a personal, non-exclusive, non-transferable licence to access them for your own use while your membership is active. You may not share, distribute, sell, reproduce, publish or use them in any commercial setting, and you may not submit them to any artificial intelligence system for training or generation.

Breach terminates your licence and your membership immediately, without refund, and I reserve the right to seek injunctive relief in addition to damages.


13. REFUNDS

The Sofa is not covered by a money-back guarantee. The 30 day guarantee that applies to workshops and digital products does not apply to membership.

No refund is issued for any unused portion of a billing cycle, for sessions not attended, for recordings that were not made available, or following cancellation, suspension or removal.

The single exception is set out in section 15.


14. SUSPENSION AND REMOVAL

I may suspend or remove any member who breaches section 1, breaches section 2, shares access in breach of section 8, breaches section 12, or whose conduct makes the group unsafe or unwelcoming for others.

Where the breach concerns confidentiality, abuse or harassment, removal is immediate.

A removed member forfeits all remaining access and no refund is due.

Removal ends your access. It does not end your obligations under section 1, which continue permanently.


15. CHANGES TO THE PROGRAM

I may change the format, curriculum, schedule, platform or benefits of The Sofa. Material changes will be notified by email in advance.

I may discontinue The Sofa at any time, and will give 30 days' notice where practicable. If I discontinue the membership, members receive a pro-rated refund for the unused portion of their current billing cycle or pass term.

I may amend these terms. The version published at the time of your purchase or renewal governs that cycle. Reasonable notice of any material change will be given by email, and continuing your membership after the stated date constitutes acceptance.


16. LIABILITY AND GENERAL

The provisions of the AnimalHypnoShift Terms and Conditions concerning scope of services and results, your animal, liability, indemnity, third-party platforms, governing law, dispute resolution, severability, entire agreement, waiver and assignment apply in full to your membership and are incorporated here.

Community and delivery platforms including Zoom, Facebook and GoHighLevel are operated by third parties outside my control. I am not responsible for their outages, changes, or any action they take in respect of your account.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
